Liability

These ‘Liability' provisions should be read carefully as they exclude or limit our legal liability in connection with your use of this Site. Nothing in these Terms shall exclude or limit any person's liability to the extent it is not permissible under applicable law, including without limitation, including for (a) death or personal injury caused by its negligence, or (b) fraud.

To the extent permissible by applicable laws and/ or regulations neither BNPP nor any of its group members, agents, licensors or delegates or its or their directors, officers or employees will be liable for any Losses (as defined below), including, but not limited to Losses incurred or suffered by you directly or indirectly in connection with:

Choice of law

These terms shall be governed by English law and you agree that the English courts shall have exclusive jurisdiction to determine any matter or dispute arising out of or in connection with this Site or these Terms. If for any reason, a competent court finds any part of these Terms invalid, unlawful or unenforceable to any extent, BNPP shall delete the relevant part from the Terms and the remainder of the Terms shall continue to be valid and enforceable to the fullest extent permitted by English law.

These Terms together with any supplemental BNPP website terms shall contain the entire agreement and understanding of the parties, and supersede all prior agreements, understandings or arrangements in relation to this Site.

To the extent that the European General Data Protection Regulation applies, in accordance with applicable law, this Data Protection Notice provides you with detailed information relating to the protection of your personal data by BNP Paribas S.A. We collect and use your personal data provided vou have given your consent to this, for advertising use, i.e. processing that serves the preparation, implementation or follow-up of advertising measures, and specifically to provide marketing services, such as the newsletter, printed articles, as well as personal data that is required for website functions.

2. Why And On Which Basis Do We Use Your Personal Data?

We partly process your data in an automated manner with the objective to evaluate certain personal aspects (profiling). Profiling is used by us, for instance, to be capable to purposefully informing you about products and providing you with advice, we use evaluation instruments. These allow for a demand-focused communication and advertising, including market research and opinion research.


5. Transfers Of Personal Data Outside The EEA

In certain circumstances, we may transfer your data to another country. In case of international transfers originating from the European Economic Area (EEA), to a non-EEA country, where the European Commission has recognised a non-EEA country as providing an adequate level of data protection, your personal data will be transferred on this basis.
For transfers to non-EEA countries where the level of protection has not been recognised as adequate by the European Commission, we will either rely on a derogation applicable to the specific situation (e.g. if the transfer is necessary to perform our contract with you such as when making an international payment) or implement standard contractual clauses approved by the European Commission to ensure the protection of your personal data.

6. How Long Do We Keep Your Personal Data For?

We only retain your personal data as long and as far as required for the above mentioned services. Afterwards, we will immediately delete your personal data, unless, its further processing is required by statutory provisions or for safeguarding evidence within the framework of the statutes of limitations


7. What Are Your Rights And How Can You Exercise Them?

Depending on the data protection laws which apply to your situation, you have certain rights in respect of your personal data. In the event that the European General Data Protection Regulation applies, such as where a BNP Paribas entity within the EEA controls your personal data in accordance with applicable law, you have the following rights:

  • To rectify: where you consider that your personal data is inaccurate or incomplete, you can require that such personal data be modified accordingly.
  • To erase: you can require the deletion of your personal data, to the extent permitted by law.
  • To restrict: you can request the restriction of the processing of your personal data.
  • To object: you can object to the processing of your personal data, on grounds relating to your particular situation. You have the absolute right to object to the processing of your personal data for direct marketing purposes, which includes profiling related to such direct marketing.
  • To withdraw your consent: where you have given your consent for the processing of your personal data, you have the right to withdraw your consent at any time.
  • To data portability: where legally applicable, you have the right to have the personal data you have provided to us be returned to you or, where technically feasible, transferred to a third party.
